VPSFix Mail Email & Anti-Spam Policy

This Email & Anti-Spam Policy applies to all use of VPSFix Mail, including both:

  • Managed plans, where VPSFix provides or operates the sending infrastructure; and
  • Unmanaged / Bring Your Own Sending plans, where the customer connects a third-party sending account or provider.

This policy forms part of the VPSFix Terms of Service and Acceptable Use Policy.

1. Permission-Based Email

VPSFix Mail is intended for legitimate email marketing, transactional messaging, and other lawful email communication.

You may send marketing email only to recipients for whom you have an appropriate basis to send.

For marketing communications, this generally means that recipients:

  • directly requested or agreed to receive the relevant type of email;
  • entered into a relationship with your organization under circumstances where the communication is lawfully permitted; or
  • otherwise may lawfully receive the communication under applicable law.

You are responsible for determining the legal basis applicable to your recipients and jurisdiction.

2. Prohibited Lists and Data Sources

You may not use VPSFix Mail to send marketing email to addresses obtained primarily through:

  • purchased mailing lists;
  • rented mailing lists;
  • scraped websites;
  • harvested email addresses;
  • automated address collection;
  • data breaches or stolen databases;
  • third-party lists where recipients did not reasonably agree to receive email from you;
  • list sharing between unrelated organizations without appropriate permission;
  • generated or guessed email addresses;
  • any other source that results in unsolicited bulk email.

The fact that an address is publicly visible does not by itself mean that the recipient has agreed to receive marketing email.

3. Cold Outreach

VPSFix Mail is not intended to provide infrastructure for unsolicited bulk cold-email campaigns.

Large-scale cold outreach, especially using scraped, purchased, generated, or third-party prospect data, is prohibited.

Legitimate one-to-one business communication may be treated differently from bulk marketing depending on the circumstances and applicable law, but customers may not use this distinction to operate mass unsolicited campaigns through VPSFix Mail.

Managed plans may be subject to stricter restrictions because customer activity can affect shared sending reputation and provider standing.

4. Sender Identification

Messages must accurately identify the sender.

You may not:

  • use deceptive sender names;
  • forge sender addresses;
  • impersonate another person or organization;
  • use misleading domains;
  • conceal the true commercial identity of the sender where disclosure is required;
  • manipulate headers in a deceptive manner.

Marketing messages should contain sufficient information for the recipient to identify the organization responsible for the message.

5. Unsubscribe Requirements

Marketing emails must include a clear and functional unsubscribe mechanism where required.

Unsubscribe requests must be honored promptly.

You may not:

  • continue intentionally sending marketing messages to recipients who have opted out;
  • require unreasonable steps to unsubscribe;
  • charge a fee for unsubscribing;
  • require recipients to provide unnecessary information to opt out;
  • re-import suppressed or unsubscribed recipients for the purpose of bypassing their opt-out.

VPSFix Mail may maintain suppression data to help prevent accidental re-mailing of unsubscribed or otherwise suppressed addresses.

6. Bounce and Complaint Management

You are responsible for maintaining reasonable list quality.

You must not repeatedly send to:

  • addresses known to be invalid;
  • recipients who consistently hard-bounce;
  • recipients who have complained;
  • addresses suppressed because of prior abuse or deliverability events.

VPSFix may automatically suppress addresses based on bounce, complaint, or abuse information.

Customers must not intentionally bypass those suppression controls.

7. Managed Plans

For Managed VPSFix Mail plans, VPSFix operates or controls the sending infrastructure used by the service.

Because multiple customers may depend on the reputation and availability of that infrastructure, VPSFix may impose additional controls, including:

  • manual account approval;
  • sending-volume limits;
  • sending-rate limits;
  • temporary throttling;
  • campaign review;
  • requests for information regarding mailing-list acquisition;
  • requests for evidence of recipient permission;
  • temporary sending pauses;
  • domain or identity verification requirements;
  • restrictions based on bounce or complaint activity.

Purchased plan limits represent the maximum service allowance available to the account. They do not guarantee that the full volume may always be sent immediately.

VPSFix may reduce or pause sending when reasonably necessary to protect:

  • sender reputation;
  • IP reputation;
  • domain reputation;
  • Amazon SES or other provider accounts;
  • shared infrastructure;
  • other customers;
  • VPSFix’s ability to continue providing the service.

8. Unmanaged / Bring Your Own Sending Plans

For Unmanaged plans, the customer connects and operates their own supported sending provider or account.

The customer is responsible for:

  • obtaining and maintaining the sending-provider account;
  • provider approval;
  • sending quotas;
  • account billing;
  • sender verification;
  • domain authentication;
  • SMTP or API credentials;
  • reputation;
  • provider restrictions;
  • deliverability;
  • compliance with the provider’s policies.

VPSFix does not control whether the customer’s sending provider approves, restricts, suspends, or terminates the customer’s account.

However, using your own sending provider does not exempt you from this Email & Anti-Spam Policy.

VPSFix may still suspend VPSFix Mail access where the platform is being used for spam, phishing, abuse, or other prohibited activity.

9. Sending Providers

Sending providers may independently impose their own acceptable-use, anti-spam, content, quota, and reputation requirements.

For Managed plans, VPSFix may be required to take action in response to warnings, restrictions, or enforcement by the underlying provider.

For Unmanaged plans, the customer is responsible for resolving issues with their own provider.

VPSFix will not advise customers to misrepresent their sending practices or provide false information to a sending provider.

10. Deliverability

VPSFix does not guarantee:

  • inbox placement;
  • delivery to every recipient;
  • avoidance of spam folders;
  • specific open rates;
  • click rates;
  • campaign performance;
  • sending-provider approval;
  • uninterrupted sending-provider availability;
  • removal from third-party blocklists.

Delivery depends on many factors outside VPSFix’s direct control, including sender reputation, recipient behavior, mailbox-provider filtering, content, domain history, authentication, list quality, and sending-provider policies.

11. Email Credits

Email credits represent a usage allowance within VPSFix Mail.

Email credits:

  • are not currency;
  • have no cash value;
  • are not a guarantee of successful delivery;
  • do not guarantee equivalent third-party provider quota;
  • may expire or reset according to the applicable plan;
  • are not refundable merely because recipients reject or filter messages.

An attempted or accepted sending operation may consume credits even if a recipient server later rejects, filters, or does not display the message as expected, depending on how the platform records usage.

12. List Verification

Email verification can reduce obvious invalid addresses but does not establish consent.

A verified email address is not automatically a permitted marketing recipient.

Customers remain responsible for the source and lawful use of all contacts.

13. Monitoring and Review

VPSFix may use available operational information to detect potential abuse, including:

  • bounce rates;
  • complaint rates;
  • sending patterns;
  • unusual volume changes;
  • blocklist events;
  • provider warnings;
  • abuse reports;
  • campaign metadata;
  • other indicators reasonably relevant to platform or sender reputation.

VPSFix does not routinely review customer content solely for marketing purposes, but may review relevant information where reasonably necessary to investigate abuse, security issues, policy violations, or provider enforcement.

14. Evidence of List Source or Consent

VPSFix may request information about how mailing lists were collected.

Examples may include:

  • signup forms;
  • website URLs;
  • consent language;
  • registration records;
  • customer relationship information;
  • import source;
  • campaign history;
  • other reasonable evidence relating to list acquisition.

Failure to provide sufficient information may result in restrictions where VPSFix reasonably believes continued sending presents an abuse or reputation risk.

15. Enforcement

Depending on the severity and circumstances of a violation, VPSFix may:

  • issue a warning;
  • require corrective action;
  • throttle sending;
  • pause a campaign;
  • temporarily disable sending;
  • suppress recipients;
  • suspend VPSFix Mail access;
  • terminate the service.

Serious abuse, including phishing, fraud, deliberate spam operations, forged identities, or intentional attempts to evade enforcement, may result in immediate suspension or termination.

16. Policy Violations and Refunds

Suspension or termination for violation of this policy does not automatically entitle the customer to a refund.

Refund eligibility is governed by the VPSFix Refund and Cancellation Policy.

17. Customer Responsibility

You are responsible for ensuring that your email activity complies with:

  • this policy;
  • the VPSFix Acceptable Use Policy;
  • applicable laws;
  • your sending provider’s rules;
  • obligations applicable to the jurisdictions in which you and your recipients operate.

VPSFix account approval does not constitute legal approval of your mailing list, campaign, or business model.

18. Changes to This Policy

VPSFix may update this policy to reflect changes in the service, sending-provider requirements, abuse patterns, or applicable legal requirements.

The effective date of the current version appears at the top of this page.
